The Settlement will provide Settlement Class members with the opportunity to make a claim for Credit Monitoring, Extraordinary Losses, Ordinary Losses and\/or Compensation for Lost Time. In lieu of Extraordinary Losses, Ordinary Losses and\/or Compensation for Lost Time, Settlement Class Members may make a claim for the Alternative Cash Payment of $40.00.<\/p>

<\/p>

1. C<\/strong>redit Monitoring Services. <\/strong>Settlement Class Members shall be offered an opportunity to enroll in two (2) years of Credit Monitoring Services to include credit monitoring through one national credit reporting bureau and with at least $1,000,000 in identity theft insurance.<\/li>
2. Extraordinary Losses <\/strong>up to a total of $5,000.00 per Settlement Class Member in compensation for the submission of a valid and timely claim form for monetary losses that meet the following conditions:
  
  The loss is an actual, documented, and unreimbursed monetary loss caused by (A) misuse of the Settlement Class Member’s Private Information or (B) fraud associated with the Settlement Class Member’s Private Information;<\/li>
  The loss noted in (A), or (B) was more likely than not caused by the Data Incident;<\/li>
  The loss occurred between July 26, 2024, and July 13, 2026<\/strong>;<\/li>
  The loss is not already covered by the Ordinary Loss or Lost Time categories and the Settlement Class Member made reasonable efforts to avoid, or seek reimbursement for, the loss, including but not limited to exhaustion of all of the Settlement Class Member’s credit monitoring insurance and identity theft insurance.<\/li> <\/ol> <\/li>
  Ordinary Losses <\/strong>of up to a total of $375.00 per claimant, upon submission of a valid claim with supporting documentation for out-of-pocket losses incurred or spent between July 26, 2024, and the Claims deadline:
  
  Out-of-pocket expenses incurred as a result of the Data Incident, including unreimbursed bank fees, long-distance phone, and cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage or gasoline for local travel;<\/li>
  Fees for credit reports, credit monitoring or other identity theft insurance products purchased as a result of the Data Incident;<\/li> <\/ol> <\/li>
  Compensation for Lost Time<\/strong>. Settlement Class Members who spent time monitoring accounts or otherwise dealing with issues related to the Data Incident can submit a claim for reimbursement of $30.00 per hour up to 3 hours (for a total of $90.00) provided they provide an attestation on the Claim Form indicating the activities they performed and how they were related to the Data Incident.<\/li>
  An Alternative Cash Payment<\/strong>. As an alternative to Claims for Out-of-Pocket Losses, Extraordinary Losses or Losses due to Lost Time, Settlement Class Members may elect to receive a one-time cash payment of forty dollars ($40.00). This payment is intended as an alternative remedy and is available to individuals who do not submit claims for ordinary, lost time or extraordinary losses. Individuals who elect an Alternative Cash Payment, however, are still eligible to elect the Credit Monitoring benefit. To receive this payment, individuals must submit a valid and timely claim affirming that they experienced disruption or concern as a result of the Data Security Incident but are not pursuing compensation for other losses under this Agreement<\/a>.<\/li> <\/ol> <\/li> <\/ol>
